A Division Bench, comprising Justice Sathish K Agnihothri and Justice K K Sasidharan, in its order said, "In view of the submissions made by the state that adequate security is being provided to the Chief Minister, there is no need for issuance of any direction to the Ministry of Home Affairs and the Government of India on the matter at this point of time."
Petitioner R Balaji, an advocate, sought SPG protection to Jayalalithaa apprehending security threat to her following strict actions taken by her against terrorist outfits.
Advocate General A L Somayaji told the court that the security provided to the Chief Minister by the state presently is sufficient and the SPG security sought by the petitioner is beyond the purview of the State Home Secretary and the DGP.
The bench said "since the contention of the state that the security provided at present to the Chief Minister is sufficient and there are competent officers in the state force to give full fledged security, the petitioner has no case that state police committed serious lapse in the matter of providing adequate security to the Chief Minister."
