The Bombay High Court today said it was inclined to grant bail to former Delhi University professor G N Saibaba, arrested for alleged Maoist links, on humanitarian grounds and his medical condition.
A division bench of Chief Justice Mohit Shah and Justice A K Menon had taken suo moto (on its own) cognizance of a letter written by activist Purnima Upadhyay highlighting the deteriorating health condition of Saibaba in the Nagpur jail where he is held since his arrest last year.
The Court was informed that the sessions court and even the High Court had earlier rejected Saibaba's bail conditions which was filed on grounds of merit.
The Court today observed that while earlier the professor's bail was rejected on merit this time bail should be granted considering his health.
The Court directed the state government to file their reply by June 30 when it will hear the matter.
Saibaba, who is 90 per cent handicapped due to ailments related to neurology and is wheel-chair bound, was on High Court directions earlier taken to Nagpur's Neuron hospital for a check-up.
The High Court had earlier this week directed jail authorities to admit Saibaba to any private hospital of his choice for treatment.
