HC order on NPX commercial project of Noida

The Allahabad High Court today directed Noida Authority to pull down any unauthorized construction that may have come up on the ground floor of NPX commercial project in Sector 153 of the city.
The order was given to ensure that no portion of the stilt area - which is supposed to be used for parking - was sold to any buyer by the builder.
A division bench comprising Chief Justice D B Bhosle and Justice Yashwant Verma passed the order while disposing of a petition filed by NPX Unit Owners Welfare Association.
The Association had moved the court submitting that initially the builderHi-Lead Infotech had put out advertisements in the year 2009 with regard to the NPX (Nehru Phase Extension) commercial project for shops on the ground floor.
However, the company came up with a revised floor plan later wherein shops on the ground floor were showed "merged" with the first floor.
The petitioners accused the builder of fraud, alleging that the shops on the ground floor were now being sold to new buyers on a higher price.
However, this was repudiated by the builder's counsel who submitted that the entire stilt area will be used for parking.
The court, while passing the directions, held that no construction be allowed on the stilt area and that the same be used for no other purpose than parking.
The court also ordered that possession of shops on the first floor be given to respective buyers within eight weeks.
