A bench of Chief Justice G Rohini and Justice R S Endlaw refused to entertain the petition which alleged "pathetic inaction" on the part of the government in "curbing" import and search of pre-natal gender determination tests and kits online.
"There is already a remedy available under the law for prayers sought in the petition. We are not inclined to entertain the petition," the court said.
Under the PNDT Act, pre-natal sex determination is banned.
The petition had claimed there were several online stores, which sells such kits for prices ranging from USD 19 to USD 500.
These tests or kits are packed in the US, where sex determination is legal, and are transported here, it had said.
