A Lucknow bench comprising justices Umanath Singh and Mahendra Dayal issued notice to the EC on a writ petition filed by social activist Nutan Thakur.
The petitioner submitted that when political parties declare their candidates or any independent announces his candidature, from that very date their elections expenses should be taken into account in view of the limit prescribed by the Election Commission for ensuring free and fair elections.
The court after hearing the arguments of counsel of the parties concerned directed Election Commission to file its reply by way of counter affidavit within two weeks .
The court fixed August 7 as the next date of hearing in this matter.
