The Delhi High Court today summoned the Registrar of Armed Force Tribunal for his failure to comply with its earlier order for fresh adjudication of a naval officer's plea who was awarded punishment of displeasure for alleged negligence on duty on board a submarine in 2002.
Issuing show-cause notices to the Principal Registrar and also a section officer of the AFT, a bench of justices S Ravindra Bhat and S K Mishra directed them to appear in person on April 1 before it and explain the reasons for non compliance of November 23, 2012 order.
The bench passed the order while hearing a plea of Lieutenant Commander Deepak Kanathey, filed through counsel Sukhjinder Singh, alleging that the AFT Registrar instead of complying with the order for re-hearing the case asked his counsel to get it corrected before the high court.
According to the navy officer's plea, his counsel Singh, in his communication on December 17, 2012, had requested the AFT registrar to list the petitioner's case (T.A.178/2010) for re-hearing following high court's November 23, 2012 order.
However, the Registrar in his letter on February 7,2013 has asked his counsel to get this court's order(dated 23/12/2012) corrected as the reference of his case (R.P. No 645/2012), was absent in that order.
The Navy officer was awarded with the punishment of 'displeasure' for alleged negligence in performing his duty as Executive Officer on board Indian Navy submarine INS Sindhukesari in 2002.
The officer was dealing with torpedos on board the Russian origin Kilo Class submarine.
