Family members of a 57-year-old man, who died after a DTC bus ran over him, have been awarded a compensation of over Rs 35 lakh by a Motor Accident Claims Tribunal (MACT) here.
MACT Presiding Officer Sameer Bajpai directed the United India Insurance Company Ltd, insurers of the Delhi Transport Corporation bus, to pay Rs?35.30 lakh to five family members of Nooruddin, who was killed in the 2015 accident.
The tribunal relied on the testimony of an eyewitness, an FIR, a charge sheet, a mechanical inspection report, the victim's medical bills and other documents placed on record while deciding on the petition.
"Nothing material came in the cross?examination of the eyewitness to show that the accident had not occurred due to rash and negligent driving...By the driver. Hence, he can safely be held negligent for causing the accident," it said.
According to the petition filed on July 30, 2015, by the victim's wife, Nooruddin was crossing the road on the BRT corridor near Chirag Delhi when he was run over by the bus.
A woman, who witnessed the accident, took the victim to the AIIMS Trauma Centre, it said, adding that Nooruddin underwent treatment for over five months before he died.
He left behind his wife, three daughters and a minor son.
During the proceedings, the driver of the bus and the DTC had denied the claims of the petition. The insurance company had made an offer of Rs eight lakh to the family members, which they turned down.
