A bench comprising justices J Chelameswar and R K Agrawal also issued notices to all respondents including PIL petitioners Abdul Ahad Shah and other civil society members on whose plea the high court has been entertaining the matter.
The order was passed on the appeal filed by the state government which was supported by Additional Solicitor General Maninder Singh, who appeared for the army.
The PIL filed in the high court raised several issues including re-investigation into the alleged mass rape of several women allegedly by army men in 1991.
They had also sought directions for implementing recommendation of SHRC in the case.
