"Needless to say that the factum of hitting from behind in itself proves negligence on the part of the driver of the offending vehicle unless some reasonable explanation comes from his side which is absent in the present case," MACT presiding officer Naveen Arora said.
The tribunal ordered IFFCO Tokio General Insurance Co. Ltd, the insurer of the offending tanker, to pay the amount to the mother of Kalkaji-resident Daman Kapoor who met with the accident on August 30, 2013.
Daman was taken to a nearby hospital where he was declared brought dead.
It was also alleged that the driver of the tanker fled the spot after the incident.
The tribunal, after considering the various factors like loss of dependency, age of the deceased, loss of love and affection, income of the deceased awarded a compensation of Rs 10,45,800.
