Man accused of raping nephew's wife gets anticipatory bail

A 50-year-old man, accused of repeatedly raping his nephew's wife, has been granted anticipatory bail by a Delhi court.
Additional Sessions Judge Umed Singh Grewal granted anticipatory bail to Anil Kumar, who was accused of raping the complainant and threatening to make her obscene photographs public if she protested.
"Incident of rape is alleged to have taken place on May 23 and was repeated several times. The complainant did not report the matter to the police or the court though she used to visit Rohini court regularly.
"Her husband came out of jail on June 4 but she preferred complaint only on July 6 and FIR was registered on July 15. This huge delay is indigestible," the court noted while granting anticipatory bail to the accused.
The ASJ considered the submission of Kumar's counsel K K Sharma that the accused had been falsely implicated at the behest of his nephew (complainant's husband), who is a habitual offender, and complaint of rape is a fallout of extortion complaint lodged by Kumar against him.
He said the complainant's husband had been lodged in jail in Muradabad and Tihar in theft cases and also used to deal in trafficking of minor girls. He was threatening Kumar to give him Rs 50,000 or else he would implicate him in a criminal case, the counsel alleged.
Kumar had then made a complaint of extortion against his nephew at Sambhal in Uttar Pradesh. He alleged that the complainant was a woman of low character and runs brothel.
The prosecution opposed the anticipatory bail plea saying even if it is presumed that victim is a woman of easy virtue, it does not give a licence to the accused to rape her.
