Man acquitted of rape charges, woman resiled from allegation

A man accused of raping a divorcee has been acquitted by a Delhi court after the woman resiled from her allegation and said that she had sexual relation with him with her "consent".
Additional sessions judge Yogesh Khanna absolved the Delhi resident of the charges of raping and cheating the woman, observing that she had made the complaint in a "fit of anger as the accused was delaying his marriage with her".
The court said that the accused becomes entitled to benefit of doubt as the woman said that "whatever had happened with her was with her own consent".
The judge also observed that the woman in her deposition before him had voluntarily stated that now she has married the accused on April 4 and is living happily with him.
"So the accused becomes entitled to be acquitted of the charges framed against him," the judge added.
The man was apprehended by police after the woman in March lodged a complaint alleging that he raped her after becoming acquainted with her while she was working with a beauty parlour here.
The woman, a native of Darjeeling in West Bengal, had further alleged that in April 2013 she got separated from her husband and started living with the accused, who on the false pretext of marrying her had made physical relations without her consent.
She also told the police that the accused stole her jewellery and cash of Rs 18,000 and fled away from Delhi in February.
However, in her testimony before the court, she denied that the accused ever took her jewellery or cash or that he had ever beaten her, the court noted.
