Hearing the Petition filed by S Anwar, Justice S Vimala ordered notice to the Jamath functionaries including S A Basheer Ahamed (President) and M Seeni Mohammed (Secretary) seeking their explanationwithin two weeks.
Anwar submitted that that Basheer and Seeni and 20 others "arbitrarily" selected the new office bearers of the Jamath against which gave a complaint.
Anwar filed a petition before the High Court seeking to remove the encroachments and the court directed RamanathapuramDistrict Collector to take actionwithin six weeks.
The President and secretaryalso conducted "Katta panchayat" (Kangroo court) and arbitrarily imposed fine on him against his actions following which he gave a police complaint, he submitted.
He also filed a writ petition against the actions of the Jamath functionaries.
The High court ordered Collector and Police to take appropriate action on the representation from him following which a case was registered against the functionaries under various IPC Sections.
They were also preventing him from entering the mosque even to offer prayer.
He submitted that though he had sent a complaint to the Collectorand police officials, no action was taken so far following which he approached the High Court.
Living in R S Mangalam and offering prayer at the Mosque was his fundamental right. By excommunicating, the fundamental right guaranteed under constitution had been violated, he contented.
