Justice R P Sondur Baldota today issued notice to Prince and posted the petition for hearing on August 23.
On July 3 Yukta filed a police case against her husband, parents-in-law and sisters-in-law under sections 498A (cruelty) and 406 (criminal breach of trust) of Indian Penal Code. She also accused her husband of offence under section 377 (unnatural sex).
The sessions court granted them interim relief from arrest till August 31. Yukta has challenged this.
"His (Prince) application is posted for hearing tomorrow before the sessions court. The sessions court while granting him interim relief observed that the probe is at a preliminary stage and hence it would not go into the merits of the case but in its order the court said that after perusing the complaint it feels harassment case is not made out," Yukta's lawyers Pradeep Havnur and Jamshed Mistry said.
In 2008, Yukta married Prince whose family has a transport and hospitality business in Nagpur. She has been staying with her parents and three-year-old son for the last one year after falling out with husband and in-laws.
