Dismissing the petition by National Development Front (NDF) worker Muhammad Fazal's brother Abdul Sathar, the court held "No sufficient and valid reasons exists to order a further investigation as prayed for."
Two CPI(M) leaders from the politically-sensitive Kannur district are among the eight accused in the case related to the murder of Fazal, a former Marxist party worker, on October 22, 2006 at Thalassery being investigated by the CBI.
Fazal's brother sought further probe following the alleged confession recently by the RSS worker, who is in custody in another murder case, that Fazal was hacked to death by a group of RSS workers, including him.
The petitioner had submitted a video showing the RSS worker making the "confession" before police.
In his order, Additional District and Sessions Judge Kauser Edappagath pointed out that the deceased's wife, on whose plea the Kerala High Court had ordered the CBI probe, has not come out with any complaint about the interrogation being conducted by the central agency.
Eight persons, including two CPI(M) local leaders Karayi Rajan and Karayi Chandrashekharan, had been arrested by the CBI in connection with the case.
