Seikh Hira was beaten up by a mob at Haraipur village on Friday and died late on that night while being taken to a Hospital.
The relatives of Seikh Hira had lodged a police complaint against eight persons.
After the complaint was lodged, the police started the case under section under section 304 of IPC.
Superintendent of Police of Birbhum Rasid Munir Khan said today that "on Saturday the concerned investigating officer of Suri police station registered the case under section 304. When I came to know this I ordered to modify the charges immediately and submit application before the court to change the sections."
The CPI(M) which had claimed that Hira was its supporter had strongly opposed the police action of lodging the case against the eight accused under section 304 of IPC and had demanded that the case be started under section 302 instead.
