The Delhi High Court today disposed of as infructuous a Delhi police plea for cancellation of bail granted to Aruna Chadha, an aide of former Haryana minister Gopal Kanda, accused of driving airhostess Geetika Sharma to commit suicide.
A bench of Justice J R Midha disposed of the police plea for cancellation of Aruna's interim bail granted by the trial court, noting that it was to expire on November 15. The bail was granted for the limited purpose of enabling her to take care of her nine-year-old daughter.
"Since the substantial period of interim bail is already over and as the interim bail is granted till November 15 and regular bail (plea) has already been heard by sessions court...., no useful purpose would be served in proceeding with this matter.
"The petition is therefore, disposed of as infructuous," the bench said.
The court, however, clarified that the observations made by it were only for the limited purpose of disposing of the application (for cancellation of interim bail) and shall not be construed as any opinion on the merit of the case.
The trial court, it said, shall decide her regular bail on its own merits.
Earlier, the bench was informed by the advocate Meghna Sankhla, appearing for Aruna, that the trial court has already heard arguments and reserved order on her regular bail plea.
She submitted that the prosecution had also not contested the ground on which Aruna was granted interim bail that she is a single mother of a nine-year-old girl who was forced to stay away from her because of her incarceration.
