A division bench comprising Justices V Dhanapalan and C T Selvam said upon perusing the records, it would pass orders on August 26 on the petition challenging the MLAs detention under NSA.
The state invoked provisions of NSA on Guru, who represent Jeyamkondan assembly constituency, for his provocative speech to his party's youth wing conference in Mamallapuram in April, which reportedly triggered violent incidents.
He was slapped NSA provision by an order on May 10, which the Union Home Ministry quashed on July 1. The state booked him for the second time on July three under the same law, which was also revoked by the Centre yesterday.
When the petition came up for hearing, Advocate General A L Somayaji defended invoking of NSA for the third time and submitted that when the High Court was seized of the issue, how could the Centre pass order quashing the state government order?
Additional Solicitor General P Wilson who appeared on behalf of the Central government argued that nothing prevents the Centre to revoke the detention orders passed by the state and Union government could very well exercise its powers.
After hearing arguments of both sides, the bench directed the central government to produce the records relating to revocation of NSA and as well as directed the state government to furnish the records of third detention order to enable it to pass orders on Monday.
