The Chief Judicial Magistrate in Surat civil court B S Parmar is likely to hear the application on December 15.
"Jyoti should be booked under IPC sections 153 (A) for promoting enmity between different groups, 153 (B) for imputations, assertions prejudicial to national integrity, 295 (A) for hurting religious sentiments and 500 for defamation as she has insulted those persons who do not believe in her party's ideology," said a plea filed by Yogesh Jadhvani on December 5.
Her remarks caused a huge embarrassment to BJP with the opposition holding protests in both Houses of Parliament, forcing her to tender an apology. Prime Minister Narendra Modi had expressed a "strong disapproval" over her comments while making a statement in Rajya Sabha.
