Justice P Devadass, who granted the relief, directed that he be released on bail on executing a personal bond for Rs 15,000 with two sureties each for a like sum.
He should appear before the Investigating Officer in the case at 10.30 AM on all Mondays and Fridays until further orders, the judge said.
Varun Kumar had surrendered before the court of Metropolitan Magistrate here on April 28, more than two months after the Supreme Court cancelled his anticipatory bail and directed him to surrender before a trial court in a dowry and woman harassment case. He was hospitalised the same day on a complaint of back pain.
Justice K C Karnan had said after an intervening two-year period that the police act in seeking his custodial interrogation can only be viewed as an afterthought as it was filed belatedly.
He had said the Supreme Court has given an opportunity to Varun Kumar to move regular bail application before the appropriate court after surrender, which he had done and had been remanded to judicial custody.
The court had not give an opportunity to the accused and stayed his bail application and 'as such it is unjustifiable', the judge had said.
The judge had given the direction on a petition by his former girlfriend, who sought a direction to revise the April 29 order of the Magistrate, who dismissed the petition filed by Assistant Commissioner of Police (Anti-Dowry Cell) for custodial interrogation of Varun Kumar.
The officer was accused of several charges, including dowry harassment by his former girlfriend. According to her, he had allegedly promised to marry her.
