A Delhi court has awarded three years imprisonment to a youth for assaulting a man while robbing him of over Rs 5,000 in a moving auto here in 2012.
The court held Gulzar, a resident of Ashok Nagar, guilty of causing hurt to Surjeet in Jyoti Nagar area on the night of February 11, 2012.
District and Sessions Judge J R Aryan also imposed a fine of Rs 3000 on Gulzar, who is in his mid 20s.
The court acquitted two others-- Gopal and Mukesh, the auto owner-- saying there was insufficient evidence against them.
"In totality of these facts and circumstances of the present case, I find a sentence of three years rigorous imprisonment and a fine of Rs 3,000 for offence under Section 394 (causing hurt while robbing) of the IPC will be just and proper and accordingly, I impose this sentence upon Gulzar," the judge said.
According to the police, on the fateful night, the victim boarded an auto from Loni area in the north east Delhi while Gulzar and his two associates, including the auto driver, were already present in the vehicle.
When the auto rickshaw proceeded towards Wazirabad Road, Ashok Nagar here, Gulzar and his associates started assaulting Surjeet and took out his wallet which contained Rs 700, it said, adding that they also snatched Rs 4,500 from the pocket of his trousers.
Surjeet raised an alarm, forcing auto driver Kallu, who was declared a proclaimed offender, to stop the vehicle and they tried to flee. Hearing the victim's cries, passersby gathered there and caught Gulzar. His associate Gopal was arrested later on.
During the trial, the three accused, including auto owner Mukesh, had claimed that they were falsely implicated in the case.
"Evidence is not sufficient to hold the charge proved against accused Gopal and Mukesh... Accused Gulzar is convicted under Section 394 IPC and other two accused persons, Gopal and Mukesh are acquitted of the charge," the court said.
