Youth sentenced to a year in jail for outraging girl's modesty

A youth has been sentenced to one year in jail by a Delhi court for outraging the modesty of a 21-year-old girl, a journalism graduate working with an NGO.
Additional Sessions Judge Yogesh Khanna handed down the jail term to convict Vinay Kumar, a native of Uttar Pradesh, who was facing trial for kidnapping, assaulting and for making a gesture with intention to insult the modesty of a woman.
The court, however, acquitted 25-year-old Vinay of kidnapping charges on the ground that there was no evidence that he made attempts to forcibly abduct her.
"Considering the facts and circumstances of the case, I feel that the ends of justice shall suffice if convict Vinay is sentenced to rigorous imprisonment for the offence... For one year," the court said, which also imposed a fine of Rs 10,000 on the convict.
Vinay was arrested on February 6, 2013 on the complaint made by a girl, alleging that while she was walking near the college, the boy tried to assault her and even made gestures.
"I saw a car parked near the footpath outside my college and its left side door was open. A boy was sitting on the seat next to the driver and was closing and opening the left side door of the car.
"As I walked on the footpath and reached near him, I saw the said boy had unzipped his pant...(and) was calling me to come inside the car. He came in front of me and even tried to pull me inside the car," the girl had said in her written complaint to the police.
Vinay had claimed innocence during the trial and had sought acquittal in the case. However, after he was convicted, he pleaded for leniency on the ground that he has to look after his wife and a minor kid.
The judge recommended "that appropriate compensation, under section 357-A CrPC" be given to the girl.
CrPC was amended in 2008 on the recommendations of Law Commission and Section 357-A was introduced under which the court is empowered to direct the State to pay compensation to the victim.
The court, meanwhile, suspended Vinay's jail term for one month to enable him to file an appeal against the judgment and order on sentence.
