The Karnataka High Court on Tuesday disposed of a contempt plea against the chief secretary, secretary, urban development and Bangalore
Development Authority commissioner for non-compliance of a court order directing them to submit records on allotment of “G” category sites by BDA, after its Commissioner tendered an unconditional apology.
A Division Bench disposed of the petition after BDA Commissioner T Sham Bhatt, who was present, filed an affidavit tendering an unconditional apology for the inordinate delay in submitting the documents.
Terming the delay as “unintentional”, Bhatt submitted that BDA has handed over all the 314 files containing applications and other related documents and prayed the court to take a lenient view and drop the contempt proceedings.
The petitioner, advocate S Vasudeva, submitted that there are personal letters written by the allottees to the Chief Ministers concerned starting from S M Krishna to Dharam Singh, H D Kumaraswamy and lastly Yeddyurappa, which the BDA has not produced.
At this,the court observed that in case BDA has not submitted the letters, the Committee constituted to look into the allotment of such sites is empowered to call for the said letters. Accordingly,the contempt plea was disposed of.
