The centre has already filed a special leave petition in the Supreme Court challenging the order of the Patna High Court, delivered the same day, that the CBI joint director in charge of the investigation into the animal husbandry scam should report only to the bench and not to the CBI director. Some legal experts felt that the Delhi High Courts order was on stronger legal ground than than that of the Patna High Court. However, the government has now decided that the CBI should file a separate special leave petition against the Delhi courts order too.

The CBI will argue that officers assigned to the task must report to the CBI director under the provisions of the law.
