The Allahabad High Court today issued notice to BJP MLA Prakash Dwivedi on a petition challenging his election from Banda assembly constituency in Uttar Pradesh.
A single judge bench of Justice Suneet Kumar passed the order on a petition of Vivek Kumar Singh, who had fought the assembly polls from the seat as a Congress candidate.
The petitioner has alleged that in his affidavit, Dwivedi had deliberately omitted a number of criminal cases he was facing and hence his election was liable to be set aside.

Singh has been a three-time MLA from Banda and a former minister in the state cabinet.
However, in the assembly polls held this year, he had finished a distant third - behind Dwivedi and the BSP candidate who was the runner-up.
