Additional Sessions Judge Nivedita Anil Sharma let off Delhi resident Parvesh observing that the girl had told the court that she had voluntarily gone with him.

"The gaps in the prosecution evidence, several discrepancies in the evidence and other circumstances make it highly improbable that such an incident ever took place.

"It appears from evidence that it is not a case of kidnapping but of elopement," the court said.

The court added there was no evidence to show the girl was "enticed or allured or forced by the accused" and said the evidence of the prosecution, especially the girl's deposition, is in favour of Parvesh.

According to police, Parvesh had kidnapped the girl in April last year from the custody of her parents with an intent to compel her for marriage with him.

The FIR was lodged on a complaint by the girl's father who had said her daughter was missing and after enquiring about her, he came to know that Parvesh, who was residing in their locality Uttam Nagar here, had taken her on a motorcycle. (More)
