DA case: SC rejects sacked IAS officer Tinoo Joshi's bail plea

The Supreme Court today dismissed the bail plea of sacked IAS officer Tinoo Joshi, saying she has been misusing the liberty during the period she was out on bail.

"The difficulty is the conduct of the applicant (Tinoo Joshi). She has misused her previous bail conditions," a bench of justices P C Ghose and R K Agrawal said.

It asked the officer's counsel to wait and apply for the bail before an appropriate court after the situation changes in future.

The counsel had sought indulgence on the ground that the accused was a "woman" and has been in jail for quite sometime.
 

"Everybody comes here, but we need to decide the issue on merits," the bench said.

The officer approached apex court after the Madhya Pradesh High Court in September had declined the relief sought by her on medical grounds.

She had made a dramatic surrender before special court in Bhopal on January 14, 2015, six months after eluding arrest in a disproportionate assets case. The court had then rejected her bail moved on medical grounds and sent her to judicial custody.

The Supreme Court had on December 18, 2014 had set a three -week deadline to the officer to surrender.

Her sacked IAS husband Arvind Joshi is also presently in jail in connection with a disproportionate assets case, which she is also involved.

He has recently moved the apex court seeking bail, which was declined.

The couple were dismissed last year after the Lokayukta police allegedly found assets worth several crores of rupees at their residence in Bhopal in December 2010.
