Madras High Court today directed the Union Secretary, Revenue Department, to enquire into July 12 2012 representation of one C Rajan to CBI on the circumstances in which he was allegedly fixed in a trap or alternatively, to forward a copy to CBI for a detailed inquiry within 8 weeks.
Rajan, who was Additional Director General of Revenue Intelligence, was arrested on March 7, 2012 on a complaint by one F.Ubaidullah that he had demanded illegal gratification.He was granted bail by Special Court of CBI cases on Apr 19 2012.
He then filed a petition seeking a direction to enquire into the circumstances in which an FIR was lodged against him by DIG, CBI, Chennai and to act against those responsible.
In another petition he sought a direction forbearing the CBI authorities in Delhi and Chennai from taking further action on the basis of the FIR.
Justice V Ramasubramanian who disposed of the petitions, said, the important thing to note was whether Rajan has made out a case of mala fide or not so as to warrant interference.
While mentioning Rajan's averments that he had detected import duty evasion, duty drawback fraud and export promotion capital goods fraud by Hyundai Motors Pvt Limited and had issued a show cause notice to JSW Steel Limited on Feb 22 2012 for suspected duty evasion of Rs 302 crore,put on hold by DRI, the judge said though the link between Hyundai Motors and the complaint against Rajan was very weak, averments against JSW cannot be brushed aside as products of figment of imagination.
The Judge who went into the sequence of events on the show cause notice,said Rajan's charge that a phone call by Director General of Revenue Intelligence on Dec 23 2012 not to issue it to JOSE Steels was not denied in the counter affidavit filed by
Director General, DRIB.
On the prosecution case that Raking has accepted a Rs two lank bribe and a ID,the judge noted his name was recommended for the Tamarra award and had an impeccable 30 year service record. Ranna's charge that the episode was an attempt to fix him for an oblique motive cannot be brushed aside, he said.
