HC directs DVAC to register criminal case against 2 cops

Madras High Court has directed the Directorate of Vigilance and Anti-Corruption to register a criminal case against two police personnel as the complaint filed by a woman against them was "well-founded and true beyond any iota of doubt."

Justice Aruna Jagadeesan before whom a petition filed by one Vijayalaksmi came up, in her order, said "It is seen that on an inquiry conducted by NHRC, it has been found that the allegations made by Vijayalaksmi are well-founded and true beyond any iota of doubt."

The issue relates to a mortgaged property which was sold after the person who took the loan on the property could not repay with interest. The problem started when the property fetched more money and the person who mortgaged it wanted Vijayalaksmi to refund the excess money.
 

When Vijayalaksmi approached police, she allegedly did not get any response following which she filed a complaint before the National Human Rights Commission.

The NHRC, which inquired into the complaint, in its report to DGP made clear that local police involvement in a civil dispute between two private parties "is proved" and she was threatened by Police. Vijayalaksmi also enclosed the copy of Intelligence report to DGP in which too it was mentioned about the alleged misdeeds of local police.

As there was no response, she filed a petition seeking registration of FIR against the police personnel who threatened and intimidated her and her sons.

Quoting a Supreme Court judgement, Justice Aruna Jagadeesan, in her order, said "The registration of FIR is mandatory on receipt of the complaint if the complaint reveals cognisable offence."

The DVAC is directed to register an FIR on the complaint made on January 14 and proceed with the investigation in accordance with law, the judge said.
