HC takes serious note of non-appointment of AG in UP

Allahabad High Court today took serious note of non-appointment of Advocate General in Uttar Pradesh and issued notice to the Chief Secretary to file an affidavit by tomorrow.

The order was given by the Lucknow Bench headed by senior judge Justice Uma Nath Singh and Justice Mahendra Dayal on a writ petition filed by PCS officer Harishanker Pandey.

"We are informed that the file of the petitioner had been sent for opinion of Advocate General. However, we are also informed that the Advocate General has since demitted his office on October 18 and till date his successor has not been appointed," the bench observed.
 

"State cannot be run without Advocate General or else it may create a constitutional crisis," it said.

The bench issued a notice to the Chief Secretary to file the affidavit by tomorrow and listed the matter.
