Landgrabbing:HC directs DVAC to proceed in accordance with law

Stating that investigation report filed by DVAC revealed cognizable offences have been committed by encroachers and some officals in allotment of land to construct a common park in a posh area on the city outskirts, Madras High Court today directed police to proceed in accordance with law against all offenders.

The High Court had on May 4 directed the Vigilance and Anti Corruption Department to conduct an inquiry about the encroachments and submit a report to it, on a PIL by A Kanagasabapathy, Secretary Rajanagar Welfare Association on the land allotment.

The First Bench comprising Chief Justice Sanjay Kishan Kaul and Justice Pushpa Sathyanarayana while going through the DVAC report in its order said "DVAC has submitted a report in which some unnamed officials who have the complicity. In view of the reports which have been perused by us, we direct the police authorities to proceed in accordance with law", the bench said.
 

The bench which recorded that the land was already taken over by Chennai Corporation directed the DVAC to take expeditious actions against all the offenders.

The matter relates to a Open Space Reservation land covering 16,985 sq.Ft in Neelangarai worth several crores of rupees which was encroached by some parties and started illegal construction.

Earlier the court had ordered the Chennai Corporation to inquire and file an affidavit regarding the allegation that the land was earmarked as OSR for starting a primary school.

The Corporation had submitted that the permission for construction of housing plots was granted by only Saint Thomas Mount Panchayat Union at Chittlapakkam and not by the Chennai Corporation and the relevant records are also not available.

The bench directed the DVAC to take action in accordance with law and closed the matter.
