Petition filed against CAT judicial member

The Gujarat High Court today directed a petitioner, who has sought inquiry against a judicial member of Central Administrative Tribunal (CAT) for his 'incompetence', to provide copy of the petition to the additional solicitor general.

Division bench of Chief Justice R Subhash Reddy and Justice V M Pancholi directed the petitioner Sunita Chaturvedi to provide copy of the petition to the ASG, and adjourned the hearing to November 14.

The Union Government has been made party to the petition.

Chaturvedi, citing certain cases where CAT's judicial member M Nagarajan presided over, alleged in her petition that he was "incompetent".

Nagarajan acted as both the judge and lawyer in certain cases, and even adjudicated petitions drafted by himself, the petition said, seeking inquiry under the Administrative Tribunal Act.
 

The petitioner also alleged that Nagarajan gave contradictory rulings in two similar cases; in one case he allowed the petition while in the other he dismissed it.
