2008 Malegaon blast: Bombay HC questions appeals against acquittals

The Bombay High Court on Tuesday said it was "not an open gate for everyone" to file an appeal against acquittal in the 2008 Malegaon blast case, and sought details if family members of the victims were examined as witnesses in the trial. A bench of Chief Justice Shree Chandrashekhar and Justice Gautam Ankhad was hearing an appeal filed by the family members of the six persons who lost their lives in the blast against the acquittal judgment. The appeal challenged a special court judgment acquitting the seven accused in the case, including former BJP MP Pragya Singh Thakur and Lt Col Prasad Purohit. The HC bench on Tuesday sought to know if the family members were examined as witnesses in the trial. Six family members of people who died in the 2008 Malegaon bomb blast have moved the Bombay High Court, challenging a special court judgment acquitting the seven accused in the case, including former BJP MP Pragya Singh Thakur and Lt Col Prasad Purohit. The appeal, filed on Monday by Nisar Ahmed Sayyed Bilal and five others through their advocate Mateen Shaikh, sought the HC to quash the special court judgment. An explosive device strapped to a motorcycle went off near a mosque in Malegaon town, located about 200 km from Mumbai in Maharashtra's Nashik district, on September 29, 2008, killing six persons and injuring 101 others. 2 witnesses in Sept 2008 Malegaon blast case have died: NIA tells court

The National Investigation Agency (NIA) on Monday told a special court here that two witnesses in the September 2008 Malegaon blast case who were to depose during the day have died. Special public prosecutor Avinash Rasal informed the special NIA court both succumbed to natural causes and submitted their death certificates. One of the witnesses had, in his statement to the earlier investigating agency Maharashtra's Anti Terrorism Squad (ATS), claimed he met accused Colonel Prasad Purohit and other accused in the case on several occasions during which they had spoken about their right wing group Abhinav Bharat and RSS chief Mohan Bhagwat and Indresh Kumar. So far 27 witnesses have turned hostile in the case in which BJP MP Sadhvi Pragya Singh and Purohit are accused. Malegaon blast case trial yet to examine 100 witnesses after 14 years

Fourteen years after a blast in Maharashtra's Malegaon town claimed six lives and injured more than 100 people, the trial in the case is still going on before a special NIA court here and more than witnesses are yet to be examined while 26 have turned hostile. Seven persons, including BJP MP Prgaya Singh Thakur and Lt Col Prasad Purohit, are facing trial in the case, which is being probed by the National Investigation Agency, and have been charged under the stringent Unlawful Activities (Prevention) Act (UAPA).
