A Delhi Court on Friday dismissed a plea seeking lodging of an FIR against Prime Minister Dr. Manmohan Singh and former Telecom Minister Dayanidhi Maran for their alleged role in the 2G spectrum case.

Special CBI Judge O P Saini, who dismissed this plea, also imposed a a cost of Rs 20,000 on petitioner Vivek Garg. The Special CBI Judge said that Garg had filed the application to 'seek cheap publicity and wasted the time of the court'.

Garg, who is an RTI activist, had in his plea sought a direction to the CBI to file a status report on its investigation till date in the case filed against Maran in the 2G scam.

The RTI activist had said that if the contents of the CBI's FIR is different than his complaint, then the investigating agency be directed to register a fresh or separate FIR against the Prime Minister and others.

Former Telecom Minister A. Raja, who has been accused of indulging in a scam worth Rs. 1.76 lakh crore when in office, has so far reiterated that he did everything in consultation with the Prime Minister, and said that he will prove his innocence in the 2G spectrum scam case.

Raja has repeatedly said that the Prime Minister and Finance Minister were in the loop over policy decisions related to 2G spectrum allocation.

Raja was forced to resign from the Union Cabinet after the report of the Comptroller and Auditor General (CAG) faulted him for undervaluing spectrum to favour companies who were largely ineligible for 2G spectrum, and added that the government had probably lost Rs. 1.76 lakh crore in estimated revenue.
