Govt. to seek review of SC verdict on reservations in AIIMS super speciality posts

Union Law and Justice Minister Kapil Sibal on Wednesday informed the Lok Sabha today that the government would be filing a review petition before the Supreme Court on its judgement of July 18, which ruled out reservations in super speciality posts in the All India Institute of Medical Sciences (AIIMS).

Responding to the members in the Lok Sabha who were agitated over the judgement, Sibal said reservation in these types of posts is a Constitutional right which cannot be taken away.

Cutting across party lines, most political outfits suggested that the Centre should bring a constitutional amendment without delay.

Sibal assured the members of the House that this may be done after the outcome of the review petition.

Lok Sabha Speaker Meira Kumar, who set aside the agenda for Question Hour and took up the AIIMS reservation issue, observed that in view of the agitated mood of the House the Government should think about a constitutional amendment straightaway.

Leader of Opposition in Lok Sabha, Sushma Swaraj, on her part said the apex court judgement will affect the reservation policy in future.

The Supreme Court had earlier on July 18 ruled that there can be no reservation in appointment for faculty posts in speciality and super speciality courses in medical colleges, including AIIMS.
