A bench of Justice B S Chauhan and V Gopala Gowda, however, refused to quantify the amount to be paid by each party saying it should be decided by a competent civil court.
"It is open for the DAV Managing Committee to approach the competent civil court for apportioning the liability of compensation out of 55 percent fastened upon it and the respondent no.8 (owners of Rajiv Marriage Palace auditorium)) by initiating appropriate proceedings," the bench said.
The court was hearing a petition filed by the DAV managing committee.
The high court had directed the committee and the owners of Rajiv Marriage Palace to pay 55 per cent of the compensation amount while the state government had been ordered to pay 45 per cent.
The fire, which had broken out due to an electric short circuit inside a synthetic tent packed with more than 1,500 people who were attending the school's annual day function, left 446 lives and left 200 injured.
In the meantime, the apex court asked the parties to deposit the amount before the civil judge who will disperse the amount among victims' family.
