Drugs case: Court jails Nigerian, orders deportation

A Delhi court has awarded a Nigerian national a 16-month jail term, which he has already undergone, for possessing 20 grams of cocaine in 2013.
Special judge Manoj Kumar Nagpal convicted Emmanuel under the Narcotics Drugs and Psychotropic Substances (NDPS) Act and the Foreigners Act and ordered his deportation after the sentence for illegally staying in India.
"Keeping in view the totality of the facts and circumstances of the case, Emmanuel is being sentenced to the period of imprisonment already undergone by him for all the above offences...," the court said.
It also directed the police to hand him over to the Foreigners Regional Registration Office (FRRO) for his deportation once he serves the jail term.
The court further said that "since the accused is a Nigerian national and is not having any visa or authority to stay or reside in India, it is directed that on completion of his above sentences, he shall not be set at liberty and shall be deported back to his native country as per law".
According to police, 28-year-old Emmanuel was arrested from South Extension, Part-1 area here on March 3, 2013 on a tip off that he would be supplying cocaine to a client.
On receiving the information, the officers of the raiding party laid a trap and nabbed him.
When the search was conducted, he was found to be in possession of 20 gms of cocaine, police said.
During the trial, Emmanuel sought leniency on the ground that has to look after his family as he was the sole bread earner.
