Man denied bail in harassment case lodged by wife

A man, facing prosecution in a harassment case lodged by his wife, has been denied bail by a Delhi court which said the accused had allegedly tried to set the victim afire after his father had purportedly attempted to rape her.
The court dismissed the bail plea saying though it was a matrimonial dispute but the allegations against the accused were serious.
"Keeping in view the submissions and the facts, I found that though it is a matrimonial dispute but the allegations are serious ones. An attempt to rape was made and then in order to save themselves from any embarrassment which may be caused due to disclosure of fact of attempt to rape, they poured kerosene oil of her to put her on fire.
"MLC also shows that there was smell of kerosene oil coming from the clothes of complainant. Keeping in view the gravity of offence, no ground for bail. Same is dismissed," Additional Sessions Judge Virender Kumar Bansal said.
The accused, a resident of Nangloi area of West Delhi who is in custody since March 24, had sought bail on the ground that the allegations of attempt to rape were not against him.
His counsel submitted that as per latest judgement of the Supreme Court, denial of bail cannot be used for punishment or pre-trial sentence or conviction.
He said the accused was a government servant, having roots in the society, and there was no possibility of his tampering with the evidence.
The prosecutor, however, opposed the bail plea contending that though it was a matrimonial dispute, the allegations were very serious as the victim's father-in-law had attempted to rape her.
"She somehow saved herself but when she disclosed this fact to her husband, he poured kerosene oil on her and tried to put her on fire. She again somehow saved herself," he said.
The prosecutor said the other accused -- the woman's father-in-law who had attempted to rape her, was yet to be arrested and keeping in view the gravity of offence, the man should not be granted bail.
A case under various sections of IPC including cruelty, criminal breach of trust, attempt to rape and criminal intimidation was lodged by the victim against her husband and her father-in law in 2014.
