Congress Vice-President Rahul Gandhi has filed a writ petition in the Bombay High Court seeking quashing of a case filed against him over his alleged remarks against RSS in connection with Mahatma Gandhi's assassination he had made during a rally.
The petition was filed two days back and the case came up for hearing before Justice P D Kode today.
The judge heard both the parties and fixed the next date of hearing on January 6.
While addressing a public rally at Sonale in Bhiwandi on March 6, Rahul had alleged it was "RSS people" who had killed Mahatma Gandhi.
"RSS people killed Gandhiji and today their people (BJP) talk of him...They opposed Sardar Patel and Gandhiji," he had said.
RSS had later filed a complaint against Rahul in Bhiwandi court over the remarks.
The criminal complaint had been filed by Rajesh Kunte, Secretary of RSS unit at Bhiwandi, a powerloom town near Thane.
In his complaint to the court, Kunte had said the remarks were defamatory and sought action against the Congress leader.
In October 2014, the Bhiwandi court had asked Rahul to remain present during the hearing of the case on January 7 after allowing his application for time.
