Youth jailed for 5 yrs for attempting to rape 6-year-old girl

Additional Sessions Judge Rajneesh Kumar Gupta awarded the jail term to 21-year-old Amit Mandal, a resident of Vikas Puri here, after holding him guilty for the offence of attempting to commit rape.

"In view of the above discussions, the prosecution has proved its case beyond reasonable doubt against the accused that the accused has attempted to commit rape on the girl," the court said and also imposed a fine of Rs 2,000 on him.

According to the prosecution, the case was registered on a statement of the victim's grandmother who had said that on May 19, 2010, the girl told her that Mandal had taken her to his house on the pretext of giving her toffee and had tried to rape her.

After the registration of the case, Mandal had surrendered before a court on June 21, 2010 and was arrested.

During the trial, the grandmother of the victim had told the court that she knew Mandal since his childhood and denied that she was falsely implicating him in the case as there was some dispute between the family of Mandal and the victim's family.

The victim, during the recording of statement, had told the court that Mandal had called her, upon which she went to his house where he tried to rape her.

The accused had claimed that the girl was a "tutored witness" and due to the dispute between the families, he was being falsely implicated.

The court, however, after going through the statement of the witnesses and other evidence, said the defence of the accused that he was falsely implicated in the case does not aspire confidence as he had not led any evidence.

"Keeping in view the aforesaid submissions and the facts and circumstances of the case, the convict (Mandal) is sentenced to rigorous imprisonment for five years and a fine of Rs 2,000," it said.
