The Supreme Court will hear a plea filed by the CBI challenging a Delhi High Court order suspending the life sentence of expelled BJP leader Kuldeep Singh Sengar in the 2017 Unnao rape case on December 29. According to the apex court's cause list for December 29, a bench comprising Chief Justice Surya Kant and Justices J K Maheshwari and Augustine George Masih is slated to hear the plea. Besides the plea filed by the CBI, the apex court will also hear a separate petition filed by advocates Anjale Patel and Pooja Shilpkar challenging the high court order. On December 23, the high court suspended the jail term of Sengar, who was serving a life sentence in the 2017 Unnao rape case, saying he had already served seven years and five months in prison. A plea has been filed in the Supreme Court challenging a Delhi High Court order suspending the jail term of expelled BJP leader Kuldeep Singh Sengar in the 2017 Unnao rape case. The petition filed by advocates Anjale Patel and Pooja Shilpkar has sought a stay on the high court order. They contended that the HC passed the order without considering that the trial court observed that Sengar must remain in jail for the rest of his natural life. The CBI will immediately challenge the suspension of life sentence and bail to former BJP MLA Kuldeep Singh Sengar in the Unnao rape case in the Supreme Court, officials said on Wednesday.. The decision was taken after studying the orders of a division bench of the Delhi High Court in the Unnao rape case of 2017. It was decided to file an SLP before the Supreme Court at the earliest against the orders of the high court, which granted bail to Sengar after suspending his life sentence, a CBI spokesperson said in a statement. Sengar, however, will remain in jail as he is also serving a 10-year term for the custodial death of the rape survivor's father. Sengar had filed an appeal against his life sentence, which was vehemently opposed by the CBI and the family of the victim before the high court. The Supreme Court on Tuesday refused to withdraw the CRPF security cover of the Unnao rape survivor, saying there was still a perception of threat. A bench of Justices Bela M Trivedi and P B Varale, however, removed CRPF security cover given to her family members and other witnesses noting that conviction has already taken place. "We are of the opinion that protection granted by this court to the concerned persons at the relevant time may not be continued as the case has resulted in conviction who is awarded life imprisonment. "However we make it clear that the CRPF cover for the victim shall continue till further orders of this court," the bench said. The top court said the family members and other witnesses would be at liberty to approach local police if they still feel any threat. A bench of Justices Yashwant Varma and Harish Vaidyanathan Shankar suspended his sentence, noting that Sengar's cataract surgery is fixed for Tuesday at the All India Institute of Medical Sciences here. A bench headed by Justice Prathiba M Singh suspended the sentence for the time being and directed that Sengar be admitted to AIIMS-Delhi for his medical evaluation and must remain in the capital once discharged. "Considering the history of the case as also the medical condition of the applicant, it is directed that the applicant will be released on interim bail for two weeks and he shall seek admission in AIIMS Delhi for a comprehensive medical evaluation," the bench, also comprising Justice Amit Sharma, said. The Delhi High Court Friday modified its order granting interim bail to expelled BJP leader Kuldeep Singh Sengar, serving life term for raping a minor in Uttar Pradesh's Unnao in 2017, by asking him to surrender after his daughter's tilak' ceremony and then be released again before her marriage.
