Uttarakhand likely to be first state to implement UCC, says Rajnath Singh

Defence Minister Rajnath Singh on Sunday said Uttarakhand is likely to become the first state in the country to implement a Uniform Civil Code. A Uniform Civil Code (UCC) for Uttarakhand was one of the major poll promises made by the BJP in the run-up to the state assembly elections held in 2022. Addressing a gathering at the "Uttarayani Kauthik" programme organised by people who hail from Uttarakhand, Rajnath Singh said, "I think if some state is going become first in implementing uniform civil code, it will be Uttarakhand." He, however, did not elaborate on this. After being voted to power for a second consecutive term, Uttarakhand Chief Minister Pushkar Singh Dhami gave his nod to setting up a committee headed by retired Supreme Court Judge Ranjana Prakash Desai to draft the UCC at the very first cabinet meeting headed by him. Addressing the "Uttarayani Kauthik" event in Lucknow, the Union Defence minister said Uttarakhand is not only the land of gods and brave people but is no

Assam will be third state to introduce Uniform Civil Code: CM Himanta

Assam will be the third state after Uttarakhand and Gujarat to introduce a Bill seeking a Uniform Civil Code (UCC) and it will exempt the tribal communities from the ambit of the law, Chief Minister Himanta Biswa Sarma said here on Thursday. A UCC means having a common law for all citizens of the country that is not based on religion. Personal laws and laws related to inheritance, adoption and succession are to be covered by a common code. 'We are waiting for the Uttarakhand Bill on UCC and after it is introduced, Assam will follow it with certain additional clauses,' the chief minister said at a press conference here. The Assam model will have certain innovative points as the state is fighting against child marriage and polygamy, he said. The Bill will, however, exempt the tribal communities from its ambit, Sarma said. 'We will go through the Uttarakhand Bill and see if public consultations will be possible within the next two to three months,' he said. If, however, certain ...

SC already dealt with it: Delhi HC refuses to entertain pleas seeking UCC

The Delhi High Court Friday refused to entertain a batch of petitions seeking a Uniform Civil Code (UCC), saying the Supreme Court has already dealt with the issue and has rejected the pleas. The high court said it cannot direct the legislature to enact a law and referred to an order of the apex court in which it was held that framing of law lies exclusively within the domain of legislature. "The Supreme Court order is clear and categorical. We will not go beyond the Supreme Court order. They (Law Commission) don't need us. They are an authority constituted by the Constitution to do it. They will do it," a bench of Acting Chief Justice Manmohan and Justice Mini Pushkarna said. This prompted lawyer Ashwini Kumar Upadhyay, one of the petitioners, and other petitioners to withdraw their pleas from the high court. The high court noted that the Law Commission is already seized of the issue and if petitioners wish, they can approach the commission with their suggestions. The high court

Delhi High Court to hear pleas seeking Uniform Civil Code on Dec 1

The Delhi High Court Monday listed for hearing on December 1 a batch of petitions seeking a Uniform Civil Code (UCC) and observed that it "cannot do anything" if the issue has already been decided by the Supreme Court. A bench headed by Acting Chief Justice Manmohan observed that in March, a top court bench had already declined a plea for "gender neutral" and "religion neutral" laws filed by lawyer Ashwini Kumar Upadhyay, one of the petitioners before the high court as well. The court deferred further hearing on the petitions while noting that none appeared for the petitioners during the proceedings and Upadhyay was yet to place on record his prayers in the petition before the Supreme Court. "Supreme Court has already decided the matter virtually... If the matter is covered by Supreme Court then we can't do anything," the bench, also comprising Justice Mini Pushkarna said. In April, a division bench headed by the then Chief Justice Satish Chandra Sharma had said that Upadhyay's ...

UCC to be implemented in Uttarakhand this year: CM Pushkar Singh Dhami

The Uniform Civil Code in Uttarakhand will be implemented within this year, Chief Minister Pushkar Singh Dhami said. He also said that people from outside the state have been settling down in Uttarakhand without identity verification, leading to a demographic change that has to be checked. "There should be a uniform law for every citizen in the country. It has been the demand of the people. Uttarakhand is all set to make the beginning. Under the Constitutional provisions, we will implement the UCC in the state within this year," Dhami said at a programme here on Monday. He was speaking on the theme "Growing Uttarakhand, Rising Uttarakhand". The UCC was promised to the people of the state in the run-up to the assembly polls last year, he said. "We were re-elected with a massive mandate breaking the convention of incumbent governments losing the polls. In our first decisions after forming the government, we set up a committee to draft the UCC," Dhami said. The panel has taken the .

Goa guv questions Kerala assembly's resolution against Centre's UCC

Goa Governor P S Sreedharan Pillai on Wednesday appeared questioning the resolution adopted recently by the Kerala assembly that decided to request the Central government to refrain from implementing the Uniform Civil Code in the country. Pillai was addressing a special session of the Goa legislative assembly in the presence of President Droupadi Murmu. Pointing out that the President had praised Goa for the implementation of the Uniform Civil Code, Pillai said, In other states, the daughter is entitled to one-third of property of her father and while two-thirds goes to male (son). Where is the gender justice? There is discrimination based on sex which is not allowed in the Constitution". Without taking any name, Pillai said recently a legislative assembly unanimously passed a resolution which is their right. "I am not mentioning the name. If I mention it, the shame will come to me also as I am from that state. Of course, they can express their opinion. Everybody has the right to .

Kerala CM moves resolution in assembly against imposition of UCC in country

Kerala Chief Minister Pinarayi Vijayan on Tuesday moved a resolution in the state assembly against the BJP-led central government's plan to implement the Uniform Civil Code (UCC) in the country. After the resolution was moved by the Chief Minister, several amendments and modifications were suggested by the Congress-led opposition UDF that welcomed the Left government's move. The Chief Minister said the Kerala Legislative Assembly was concerned and dismayed at the Cente's move to impose UCC and termed the action as "unilateral and hasty". The CPI(M)-led government's decision came amid an ongoing campaign against the UCC by both the ruling Left and the opposition UDF in the state, as well as various religious organisations in the state. Both the fronts had organised seminars separately in Kozhikode recently against the UCC, in which the representatives of various religious outfits took part. The Law Commission of India had last month received submissions from the public regarding ..

Union Minister Athawale urges Muslims not to oppose Uniform Civil Code

Union Minister of State for Social Justice and Empowerment Ramdas Athawale on Sunday appealed to Muslims not to oppose the Uniform Civil Code (UCC) as the code would be for their benefit. The 22nd Law Commission had recently extended the deadline for the public to send in their views on a proposed UCC till July 28. The debate around UCC was kicked off after Prime Minister Narendra Modi spoke about it at a public meeting in Madhya Pradesh last month. Addressing reporters here on a visit to Puducherry, Athawale said: "The Uniform Civil Code (UCC) is not opposed to the Muslim community and hence I appeal to the Muslims not to oppose the UCC. Muslims and Hindus would come together through UCC." Praising Prime Minister Narendra Modi for his dynamic leadership, the Union Minister said several schemes evolved and implemented by the NDA government at the Centre under the PM's stewardship has been of great help to ameliorate the lot of the poor. Over 8.75 lakh Hindu Undivided Families (HUFs) have filed income tax returns (ITRs) and claimed deductions worth Rs 3,803 crore during 2022-23, the Finance Ministry said on Tuesday. Minister of State for Finance Pankaj Chaudhary in a reply to the Rajya Sabha provided details of the number of Hindu Undivided Families (HUF) availing tax benefits (in the form of deduction under Chapter VIA of the Income-tax Act) during the last five years. To a question on whether the government has assessed the impact of the Uniform Civil Code on tax benefits to HUFs in the country, the minister said: "No such assessment has been made as there is no such Code at present". Currently, a debate is going on about the status of the HUFs, following the implementation of the Uniform Civil Code on which the Law Commission has invited comments from the public. Under Hindu Law, a HUF is a family comprising all lineally descendants of a common ancestor, including wives and unmarried daughters. This provision al

Fresh consultations on UCC needed due to importance, court orders

The government on Thursday said the Law Commission initiated fresh consultations on the issue of uniform civil code due to the "relevance and importance" of the subject and various court orders on the matter. In a written reply in Rajya Sabha, Law Minister Arjun Ram Meghwal said the 21st Law Commission had issued a consultation paper on "Reform of Family Law" on August 31, 2018. However, it had not submitted a report on the subject, he noted. "Since more than four years have lapsed from the date of issuance of the said consultation paper, the 22nd Law Commission (the present panel) decided to solicit views and ideas of the public at large and religious organisations on June 14, 2023, bearing in mind the relevance and importance of the subject matter and also various court orders on the subject of uniform civil code," he said. Responding to another question on modalities of the UCC, Meghwal said since the law panel is in process of holding consultations at this stage, "the question

UCC a political tool BJP is using to sharpen communal polarisation: Yechury

The Uniform Civil Code (UCC) is a political tool being used by the BJP to sharpen communal polarisation, CPI(M) General Secretary Sitaram Yechury said on Saturday. Uniformity does not mean equality, he stressed, while addressing a massive gathering attending a national seminar to discuss the UCC organised by the Left party here. Yechury said laws that are discriminatory have to be corrected in consultation with the entire community and not by imposing UCC from the top. "Uniformity does not mean equality. The CPI(M) stands for equality like the Constitution of India stands for equality. And it's that equality that we need to fight for...that everyone of us is first a human being and then everything else follows," Yechury said. The CPI(M) leader pointed out that the 21st Law Commission, appointed by the Modi government, had made it clear that the UCC was "neither necessary nor desirable at this stage". Yechury said any effort to impose uniformity will tear our social fabric. "UCC i
