HC lists on Feb 17 hearing of Kuldeep Sengar's appeal in Unnao rape case

The Delhi High Court on Wednesday listed for hearing on February 17 appeals by expelled BJP leader Kuldeep Sengar and others against their conviction in the custodial death case of the Unnao rape survivor's father. Justice Swarana Kanta Sharma took note of the Supreme Court's order directing the high court to decide the appeals in three months, and said "it is a time bound case now". The judge, however, deferred hearing on Wednesday after being informed that the survivor's plea seeking enhancement of the 10-year sentence was pending before a division bench of the high court, which was coming up for hearing in March. The counsel for Sengar submitted that in view of the top court's order, the survivor ought to file a plea for early hearing in the plea for enhancement of sentence and the appeals could also be taken up by the division bench. The judge directed that the matter be called on February 17 to await clarity and extended the interim bail granted to Kuldeep Sengar's brother til

Decide on Sengar's plea in 3 months in custodial death case: SC to Delhi HC

The Supreme Court on Monday asked the Delhi High Court to accord an out-of-turn hearing to expelled BJP leader Kuldeep Singh Sengar's plea challenging his conviction in the custodial death case of the Unnao rape survivor's father, and said it should be decided within three months. While refusing to entertain Sengar's plea challenging a January 19 order of the high court, a bench of Chief Justice of India Surya Kant, and Justices Joymalya Bagchi and N V Anjaria said the appeal, if any, filed by the victim's family should also be heard by the high court along with Sengar's petition. The bench was hearing Sengar's plea challenging the high court's order that had refused to suspend his 10-year jail term in the case. During the hearing, the CJI expressed disapproval over the victim's counsel giving statements in the media about the case. "We are not sitting in an ivory tower. We know a media trial is going on outside," Justice Kant said, adding he would not tolerate any "parallel trial"

Unnao rape: Sengar moves SC seeking bail in death case of survivor's father

Expelled BJP leader Kuldeep Singh Sengar has moved the Supreme Court seeking bail in the custodial death case of the Unnao rape survivor's father. The apex court will hear his plea seeking the relief on Monday. On January 19, the Delhi High Court had refused to suspend Sengar's 10-year jail term in the case on the grounds of delay in trial, saying it was partly caused by the multiple applications he had filed in the matter. On March 13, 2020, Sengar was sentenced to 10 years' rigorous imprisonment by a trial court, along with a fine of Rs 10 lakh, in the case. The trial court had said "no leniency" could be shown for killing a family's "sole bread earner". The trial court, which did not hold the accused guilty of murder in the father's case, awarded him the maximum sentence for the offence of culpable homicide not amounting to murder after holding that there was no intention to kill. Unnao rape survivor moves CBI, seeks FIR against IO for aiding Sengar

The victim of the 2017 Unnao rape case, in which ex-BJP MLA Kuldeep Singh Sengar was convicted, has approached the CBI seeking the registration of an FIR against the then-investigating officer for being hand in glove with the former legislator. The woman also claimed that she and her family were facing threats from various quarters. The development comes amid growing disappointment in several quarters after the Delhi High Court recently granted conditional bail to Sengar and suspended his life sentence in the case. Sengar, however, will remain in jail as he is also serving a 10-year term for the custodial death of the rape survivor's father. In her complaint, the victim alleged that the investigating officer conducted the probe dishonestly, with mala fides, and in such a way that Senger and the other accused may get the benefits of deliberate lapses and manipulation of facts introduced, and secure a favourable outcome. She alleged that the officer used forged school documents in t

Unnao rape case: Plea filed in SC against suspension of Sengar's jail term

A plea has been filed in the Supreme Court challenging a Delhi High Court order suspending the jail term of expelled BJP leader Kuldeep Singh Sengar in the 2017 Unnao rape case. The petition filed by advocates Anjale Patel and Pooja Shilpkar has sought a stay on the high court order. They contended that the HC passed the order without considering that the trial court observed that Sengar must remain in jail for the rest of his natural life. The HC has committed a grave error in law as well as on facts in granting bail/suspension of sentence to Sengar despite his serious criminal antecedents and his established involvement in the heinous offences of rape, they said. "The High Court failed to appreciate the material evidence relied upon by the prosecution which clearly demonstrates the barbarity and brutality of the accused, coupled with his demonstrated muscle power, financial influence and criminal propensity, as evidenced from the fact that even while the victim's father was under
