The bigger problem, though, is that Raisina Hill persists in considering regulation as another arm of government. By highlighting the tensions between executive and judiciary, both the court and the government are overlooking this fundamental issue that urgently needs to be sorted out in order to get right the whole business of appointing regulators in India.
