HC posts petition for January 30

Madras High Court today posted for hearing on January 30, a Criminal Original Petition seeking a direction to transfer the probe to CBI on sale of tickets at abnormal rates by cinema theatres in violation of Tamil Nadu Cinema Theatre Regulations amended vide a government order.
Justice R Mala, before whom the petition filed by one G Devarajan came up, posted the matter for hearing to Friday.
In his petition, Devarajan alleged that the government has fixed rates to all the cinema theatres based on facilities made available by them as per the above Government order.But theatres are selling the tickets over and above the rates fixed as per the government order which is illegal,he charged.
He alleged that tickets for the recently released Rajinikanth starrer 'LINGA' were sold at abnormal rates and he had already lodged a complaint to Commissioner of Police, Chennai City and other District Administrations.
In his plea, he said the court had earlier directed the Commissioner of Police to probe the matter and file a compliance report within three months on a petition filed by him in the same matter.
The Commissioner had given a reply that it is not the competent authority and it is only the Commercial Taxes Department which has to investigate and as such they have already informed it, which in turn replied that no criminal offence was made out,the petitioner submitted.
The Commissioner of Police has given a reply to the effect that he could not investigate the matter, the petitioner alleged and prayed the court to transfer the probe to CBI.
