Man gets 10 years jail for possessing 1.5 kg heroin

A man has been sentenced to 10 years rigorous imprisonment by a Delhi court for possessing 1.5 kg of banned heroin.
The court said Om Prakash, a resident of Uttam Nagar in west Delhi, has failed to prove his innocence and it has been established that contraband was recovered from him.
The court held the 36-year-old convict guilty under the provisions of the Narcotic Drugs and Psychotropic Substances Act and also imposed a fine of Rs one lakh on him.
"Keeping in view the proved quantity of recovered contraband which is commercial quantity and the young age of the convict, he is sentenced to undergo rigorous imprisonment for 10 years and fine in sum of Rs one lakh is also imposed ...," special NDPS judge Rakesh Kumar-I said.

"The accused has pleaded innocence and false implication and given suggestion to prosecution witnesses, however, no plausible motive has been attributed for false implication. The defence witnesses failed to prove the false implication of accused... The accused has failed to prove any defence to show his innocence. Recovery of contraband is clearly established from the accused," the court said.
It also said that in the light of consistent and reliable testimony of prosecution witnesses, the defence taken by the accused was found to be improbable.

According to the prosecution, the narcotic cell had got a tip-off that on June 12, 2013, a person possessing huge quantity of heroin would be coming near Moti Nagar Metro Station and a raid was conducted and Prakash was apprehended.

A bag which he was carrying was searched and 1.5 kg heroin was recovered in it, it said.
During the trial, Prakash denied the allegations levelled against him and claimed that he was innocent and was falsely implicated in the case.
