Tata power discom has filed a petition with the Delhi Electricity Regulatory Commission (DERC) challenging an order on compensation for unscheduled outages, which is yet to be cleared by Lt Governor Najeeb Jung.
The DERC had issued the order following directions from the city government in this regard. The discom said the Delhi government's orders are not binding on the power regulator.
The Delhi High Court had recently quashed the directions of the government where prior approval of the LG was not taken before issuing them.
However, a senior government official said the High Court verdict will have no effect on the notification issued by the DERC, which Tata discom TPDDL has challenged.
"The HC cancelled only the directions issued by the government to DERC under Section 108 of Electricity Act. But the DERC on its own can issue notifications which it has and also placed it in the Assembly," the official said.
In its petition, Tata Power said the proposals, which include making the discoms liable to pay Rs 100/hour to customers in cases of power cuts exceeding two hours, were not possible to adhere to.
