Article 370 medium through which Constitution applied to JK: SC told

Article 370, which bestowed special status on the erstwhile state of Jammu and Kashmir, was not a repository of untrammelled power but a medium through which the Constitution would apply to the state, the Supreme Court was told on Wednesday. A five-judge constitution bench headed by Chief Justice DY Chandrachud was told by senior advocate Gopal Subramanium, appearing for petitioner Muzaffar Iqbal Khan, that the Jammu and Kashmir constituent assembly did not want to abrogate Article 370 and instead permitted its continuance. Khan has challenged the two constitutional orders of the Centre issued on August 5, 2019 and August 6, 2019, by which Article 370 was abrogated. "Even though the word 'temporary' appears in the marginal notes of Article 370 of the Constitution, the resolution passed by the Jammu and Kashmir constituent assembly said that the Constitution of India must apply with these modifications. The constitution of Jammu and Kashmir and Indian Constitution were speaking to ea

Freedom suppressed all over India but most severely in J-K: Chidambaram

Senior Congress leader P Chidambaram on Sunday attacked the government over its assertion that the abrogation of Article 370 ushered peace in Jammu and Kashmir, alleging that "freedom is suppressed" all over India but it is most severely suppressed in the Union Territory. On the fourth anniversary of Article 370's abrogation, the government on Saturday highlighted that the "historic" decision ushered in peace and development in Jammu and Kashmir. The biggest change after the abrogation of the article is that the common people of Jammu and Kashmir are living life according to their own wishes, Lieutenant Governor (LG) Manoj Sinha had said in Srinagar. In a tweet, Chidambaram said, "The Government and the LG of Jammu & Kashmir celebrate the 'peace' that has descended on the State (now UT) after the abrogation of Article 37." "I wish to quote President (John) Kennedy who warned against the 'peace of the grave and the silence of the slave'," the former home minister said. If there is

The Centre on this day in 2019 had revoked Article 370, which gave special status to the erstwhile state of Jammu and Kashmir, and bifurcated it into union territories of Jammu and Kashmir and Ladakh. No mechanism to abrogate Article 370 even when everyone in J-K wants it: SC

Is there no mechanism to abrogate Article 370 even when the people of Jammu and Kashmir want it, the Supreme Court asked on Thursday and wondered if the now repealed provision can't be touched will it not amount to creating a "new category" beyond the basic structure of the Constitution. Hearing for the second day a clutch of petitions challenging the Centre's 2019 decision to abrogate Article 370 of the Constitution that accorded special status to Jammu and Kashmir, a five-judge constitution bench headed by Chief Justice DY Chandrachud wanted to know how the provision could be revoked in the absence of a constitutent assembly. The bench, also comprising Justices Sanjay Kishan Kaul, Sanjiv Khanna, BR Gavai and Surya Kant, told senior advocate Kapil Sibal, appearing for National Conference leader Mohd Akbar Lone, there are only two highly debatable issues -- whether Article 370 acquired a permanent status with the cessation of the constituent assembly of Jammu and Kashmir and whether

Who can ask for Art 370 revocation when no constituent assembly exists: SC

Who can recommend the revocation of Article 370 in Jammu and Kashmir when no constituent assembly exists there? The Supreme Court Wednesday put this question to the petitioners who have challenged the abrogation of the constitutional provision that bestowed special status on the erstwhile state. A five-judge constitution bench headed by Chief Justice DY Chandrachud today commenced hearing a batch of pleas challenging the Centre's August 5, 2019 decision to abrogate Article 370, a move that had come in for vicious attack by some major opposition parties but earned fulsome praise from those supporting the BJP. Centre's Art 370 affidavit in SC holds no legal value, claim Mehbooba, Omar

Former chief ministers of Jammu and Kashmir Mehbooba Mufti and Omar Abdullah on Monday criticised the Centre's affidavit in the Supreme Court on the abrogation of Article 370 saying it lacked logic and had on constitutional backing. "The Centre's defence lacks logic (is) illegal & unconstitutional abrogation of Article 370," PDP President Mehbooba Mufti said in a tweet. "Brute majority was used to subvert the Indian constitution that extended guarantees to the people of J&K & GOI also violated earlier rulings of Hon'ble SC which held that only J&K's constituent assembly could recommend the removal of Article 370 to the President of India," she said. The once-BJP ally also said that "drum beating about an enforced silence" in the region cannot be used to "justify constitutional harakiri." National Conference leader Omar Abdullah also took to Twitter saying the arguments put forth by the government were political and had little in the way of legality. "These are ...

The political process has to be restored in Jammu and Kashmir, veteran Congress leader Karan Singh said as he batted for early assembly elections in the Union Territory as well as reinstating its statehood. He also acknowledged that the law and order situation is "better" in Jammu and Kashmir, saying there has been a cessation of shutdown calls and "Hurriyat fatwas". But it cannot be claimed that there is "100 per cent complete control", Singh told PTI in an interview. The Congress leader said that "at some point in time, the political process has to be restored". "Statehood has to be restored. Only then (when statehood and political process is restored), we can say, that total normalcy has set in (Jammu and Kashmir)," Singh said. He highlighted that panchayat elections have already taken place, and now it is imperative to hold assembly elections as soon as possible. "It is assembly elections that are to be held now. They should be held as soon as possible. It is for the government
