Modi surname row: Purnesh Modi's original surname not Modi, Rahul tells SC

Congress leader Rahul Gandhi on Friday told the Supreme Court that the original surname of former Gujarat minister Purnesh Modi, who filed a defamation case against him, is not Modi and he belongs to the Modh Vanika Samaj. Senior advocate Abhishek Singhvi, appearing for Gandhi, told a three-judge bench of Justices B R Gavai, P S Narasimha and Sanjay Kumar that his client is not a hardened criminal and there is no conviction in any case despite several cases filed against him by BJP workers. The top court is hearing a plea by Gandhi challenging the Gujarat High Court verdict which dismissed his plea seeking a stay on his conviction in a defamation case over his "Modi surname" remark. Purnesh Modi had filed a criminal defamation case in 2019 against Gandhi over his "How come all thieves have Modi as the common surname?" remark made during an election rally in Kolar in Karnataka on April 13, 2019.

The complainant, who claims to be a BJP worker, had alleged that Gandhi's "commander-in-thief" remark in the context of the Rafale fighter jet deal amounted to defamation. A single bench of Justice S V Kotwal adjourned the hearing till September 26 on the plea filed by Gandhi challenging the summons issued to him by the local court in 2021. The Supreme Court on Friday sought responses from former Gujarat minister Purnesh Modi and the state government on Congress leader Rahul Gandhi's appeal challenging the high court verdict which dismissed his plea seeking a stay on his conviction in a defamation case over his "Modi surname" remark. A bench of Justices B R Gavai and P K Mishra issued notices to Purnesh Modi, who had filed a criminal defamation case in 2019 against Gandhi over his "How come all thieves have Modi as the common surname?" remark made during an election rally at Kolar in Karnataka on April 13, 2019, and the Gujarat government on Gandhi's appeal. The Gujarat High Court will on Friday deliver its verdict on Congress leader Rahul Gandhi's plea seeking a stay on his conviction in a criminal defamation case over his Modi surname remark. As per the causelist issued by the HC on Thursday, the court of Justice Hemant Prachchhak will deliver the verdict at 11:00 am. A stay on conviction would pave the way for Gandhi's reinstatement as a Member of Parliament. In May, Justice Prachchhak, while hearing Gandhi's plea, had refused to grant any interim relief saying it will pass a final order after the summer vacation, which ended three weeks back. During a hearing on April 29, Gandhi's lawyer had argued that a maximum punishment of two years for a bailable, non-cognisable offence meant his client could lose his Lok Sabha seat "permanently and irreversibly", which was a "very serious additional irreversible consequence to the person and the constituency he represents". A Delhi court on Thursday summoned Rajasthan Chief Minister Ashok Gehlot in a defamation complaint filed by the Union Minister Gajendra Singh Sekhawat. Additional Chief Metropolitan Magistrate (ACMM) Harpreet Singh directed Gehlot to appear before court on August 7 in the complaint filed by Shekhawat for allegedly defaming him with his remarks on the alleged Sanjivani scam. The case is related to thousands of investors allegedly getting duped of about Rs 900 crore by the Sanjivani Credit Cooperative Society. A court here in Gujarat on Tuesday issued a fresh summons to Delhi Chief Minister Arvind Kejriwal and Aam Aadmi Party's Rajya Sabha member Sanjay Singh to appear before it on June 7 in a criminal defamation case lodged by the Gujarat University over Prime Minister Narendra Modi's academic degree.
