ED to respond to Satyendar Jain's bail plea in money laundering case

The Delhi High Court on Tuesday asked the Enforcement Directorate to respond to a plea by jailed former minister Satyendar Jain seeking default bail in a money laundering case. Justice Swarana Kanta Sharma issued notice to the ED and asked it to file a status report on the matter. The court also called for the nominal roll of Jain from the jail and listed the matter for further hearing on July 9. Jain is accused of having laundered money through four companies allegedly linked to him. He has challenged a trial court's May 15 order by which he was denied default bail in the case. Jain has contended that the ED failed to complete the investigation in all respects within the statutory period and the prosecution complaint (charge sheet), which was incomplete, was filed in an attempt to deprive him of his right to default bail under the provisions of Section 167(2) of the CrPC. The ED arrested Jain on May 30 2022, in the money laundering case based on a CBI FIR lodged against him in 2

Non-recovery of cash can't be proof of no corruption: HC on Sisodia's bail

Non-recovery of cash cannot be a prima facie proof that no corruption has taken place as the offender's mind uses new technology to commit offences without leaving behind any trace, the Delhi High Court has held while denying bail to AAP leader Manish Sisodia in the excise policy scam cases. The high court said it cannot accept the argument put forth by Sisodia about non-recovery of cash from him in view of the statements of some hawala dealers and other witnesses recorded during the investigation. Justice Swarana Kanta Sharma dismissed the bail pleas filed by the former Delhi deputy chief minister in the corruption and money laundering cases lodged by the CBI and ED, respectively, in connection with the alleged liquor scam. While the two petitions were dismissed on Tuesday, the detailed order was uploaded on the high court's website on Wednesday. This court is of the view that prosecution has made out a prima facie case of commission of money laundering under Section 3 of PMLA ...

Delhi HC restrains entities from using actor Jackie Shroff's name, voice

The Delhi High Court has restrained various entities from using actor Jackie Shroff's name, including sobriquets "Jackie" and "Jaggu Dadda", voice and images for commercial purposes without permission. Justice Sanjeev Narula, in an interim order dated May 15, said the entities selling wallpapers, T-shirts and posters, etc. on e-commerce websites and operating an artificial intelligence (AI) chatbot platform were prima facie acting in violation of the actor's personality and publicity rights by exploiting and misappropriating his attributes. The judge also passed the direction against two content creators who published videos of Shroff with "extremely profane words and abuses". The court said Shroff is a celebrity and this status inherently grants him certain rights over his personality and associated attributes. "The plaintiff has established a prima facie case for grant of an ex-parte injunction. Balance of convenience lies in his favour and against defendants no. 3-4, 6-7, 13 and

In matters concerning liberty of citizens, every single day counts, says SC

Every single day counts in matters concerning the liberty of citizens, the Supreme Court said on Friday while asking the Delhi High Court to decide on the regular bail plea of a businessman in a corruption case related to the now scrapped Delhi excise policy. The petitioner's regular bail application has been heard by the high court on 40 occasions and now the matter has been adjourned to July 8, a bench of Justices B R Gavai and Sandeep Mehta was told by senior advocate Kapil Sibal, appearing for businessman Amandeep Singh Dhall. "This cannot be that after 40 hearings, you don't decide the regular bail," he said. The bench noted it has been informed that his regular bail plea was filed in July last year. "In matters concerning the liberty of citizens, every single day counts. Keeping the matter of regular bail pending after almost 11 months deprives the petitioner of his liberty," the bench said. "We request the high court to decide the bail application prior to the closure for .

Excise policy scam: HC lists for July 11 Kejriwal's plea against ED summons

The Delhi High Court on Wednesday listed for hearing on July 11 Chief Minister Arvind Kejriwal's petition challenging the summonses issued to him by the Enforcement Directorate (ED) in connection with its probe into the excise policy-linked money laundering case. A bench headed by Justice Suresh Kumar Kait granted four more weeks to the AAP leader, who was given interim bail till June 1 by the Supreme Court for campaigning in the Lok Sabha Elections, to file a rejoinder to the reply submitted by the ED. The counsel for the ED has earlier said the petition against the summonses was infructuous after Kejriwal's arrest by the agency on March 21 in the money laundering case following the high court's refusal to grant him interim protection from coercive action. On Wednesday, the agency's lawyer said the petitioner must choose the forum before which he would press his issues. The court also observed that a single judge of the high court, while rejecting the AAP leader's petition against
