Justice Dipankar Dutta restrained the Justice Arunabha Basu Commission, set up to probe the gruesome killings of three persons in Saibari, from probing why the incident occurred and who were involved till further orders.
Justice Dutta also directed the state government to file an affidavit within six weeks stating what prompted it to initiate a new judicial probe into the incident, on which a previous judicial commission had earlier submitted a report.
The matter would come up for hearing two weeks after submission of the report, Justice Dutta directed.
Petitioners Rajat Bandopadhyay and Durga Shivprasad Roy who were among the accused in the case have challenged setting up of the new commission.
A day after the United Front government in the state was dismissed by the Centre in March 1970, Congress workers and brothers Pranab Sain and Moloy Sain, besides Jiten Roy, a tutor at their residence, were beaten to death by a mob.
The Justice Tarapada Banerjee Commission had been set up by the Congress government in 1971.
The present Trinamool Congress government set up the new commission after coming to power in 2011.
